Terms of Service

1. What PickArena is — and is not
PickArena("we," "us") provides software for hosting prediction pools and contests (the "Service"). The Service is a scoreboard and communications tool. We are not a gambling operator, sportsbook, or payment intermediary of any kind:
- We do not collect, hold, or distribute entry fees or prizes.
- We do not facilitate wagering between users.
- We have no custody of user funds at any time.
Any arrangement among members of a pool — including prizes of any sort — occurs entirely off-platform, is solely between those members, and is their sole responsibility, including compliance with all laws that apply to them. We may suspend accounts that use the Service to promote unlawful activity.
2. Eligibility
You must be at least 18 years old to use the Service. By creating an account you represent that you are 18 or older and able to form a binding contract.
3. Accounts
Sign-in is by email link or Google account. You are responsible for the security of your email account. We may terminate accounts that violate these terms, abuse other users, or attempt to compromise the Service.
4. Paid plans
Pool hosting upgrades (Pool Pass, Commissioner Pro) are billed through Stripe. Pool Pass is a one-time purchase covering one pool for one season. Commissioner Pro renews yearly until cancelled via the billing portal. Full refund within 7 days of purchase if the pool has less than two weeks of activity. If a payment lapses or is refunded, affected pools become read-only; we never delete your data for non-payment.
5. Your content
Pool names, questions, and display names you create remain yours. You grant us the license needed to display them to your pool (and, if you enable a public leaderboard, to the public). Don't post anything unlawful, infringing, or abusive.
6. Service quality
We work hard to grade accurately and stay online, but the Service is provided "as is" without warranties of any kind. Scores and results may be corrected after initial grading. To the maximum extent permitted by law, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim.
7. Disputes, arbitration, governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally shall be settled by binding individual arbitration under the rules of the American Arbitration Association; you and we each waive any right to participate in a class action. Either party may instead bring qualifying claims in small-claims court.
8. Changes
We may update these terms; material changes will be announced by email or in-app at least 14 days before taking effect. Continued use after that constitutes acceptance.
